Terms of Service

1. About KelCor Technologies

KelCor Technologies (Pty) Ltd (Enterprise No. 2026/513450/07) ("KelCor", "we", "us") develops and licenses commercial software products including the PTW System, QuoteFlow System, and Safety File Manager. Our registered domain is kelcor.co.za.

2. Acceptance

By purchasing, downloading, installing, or using any KelCor software product or accessing the kelcor.co.za website, you agree to these Terms of Service. If you do not agree, do not use our products or services.

3. Licence Grant

KelCor grants you a non-exclusive, non-transferable, revocable licence to use the purchased software product subject to these terms. The licence is bound to your machine(s) via a hardware fingerprint. Each licence permits activation on up to three (3) machines. Licences may not be resold, sublicensed, or transferred to another entity without prior written consent from KelCor.

4. Subscription Terms

Subscription plans (monthly or annual) grant access to the software for the duration of the active billing period. Access is contingent on continued payment. If a subscription lapses, the software will enter a 3-day grace period, after which access will be suspended until payment is restored. Subscription fees are non-refundable except as outlined in our Refund Policy below.

5. Software Updates

Active subscribers receive all software updates released during their subscription period. Once-off (perpetual) licence holders receive updates for the major version they purchased. KelCor is under no obligation to provide updates beyond the licensed version.

6. Data and Privacy

Our software operates locally on your machine(s). We do not access, collect, or store the data you create within the software. Limited telemetry data (licence validation, version checks) is transmitted to our servers as described in our Privacy Policy.

7. Intellectual Property

All software, documentation, branding, and content remain the intellectual property of KelCor Technologies. You may not reverse-engineer, decompile, disassemble, or create derivative works from any KelCor product.

8. Limitation of Liability

KelCor software is provided "as is". While we strive for accuracy and reliability, KelCor shall not be liable for any indirect, incidental, or consequential damages arising from the use of our software. Our total liability is limited to the amount paid for the specific licence in question. KelCor software does not replace professional advice, regulatory compliance obligations, or qualified safety personnel.

9. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.

10. Amendments

KelCor reserves the right to amend these terms. Material changes will be communicated via the kelcor.co.za website. Continued use of the software after notification constitutes acceptance of the amended terms.

Refund Policy

Trial Period

All KelCor products offer a free trial download. We strongly recommend evaluating the trial version before purchasing to confirm the software meets your requirements.

Refund Eligibility

Refund requests are considered on a case-by-case basis under the following conditions:

• The request is made within 14 days of the original purchase date.
• The software has a demonstrable technical defect that prevents core functionality and cannot be resolved by our support team within a reasonable timeframe.
• The customer has contacted admin@kelcor.co.za and engaged with our support team to resolve the issue before requesting a refund.

Non-Refundable Circumstances

• Change of mind after purchase (the trial is provided for evaluation).
• Failure to meet published system requirements.
• Issues caused by third-party software, hardware failure, or network configuration.
• Subscription fees for periods already consumed.
• Requests made more than 14 days after the purchase date.

Refund Process

To request a refund, email admin@kelcor.co.za with your licence key, purchase date, and a description of the issue. Approved refunds are processed within 10 business days. The associated licence key will be revoked upon refund.

Consumer Protection

This refund policy operates within the framework of the South African Consumer Protection Act, 2008 (Act No. 68 of 2008). Nothing in this policy limits your statutory rights under applicable consumer protection legislation.

Cancellation Policy

Subscription Cancellation

You may cancel your subscription at any time. Upon cancellation:

• Your access continues until the end of the current paid billing period.
• After the billing period ends, a 3-day grace period applies during which the software will display renewal reminders.
• After the grace period, the software will be suspended. Your data remains on your machine and is not deleted.
• No further charges will be processed after cancellation.

How to Cancel

Cancel your subscription by emailing admin@kelcor.co.za with your licence key. Cancellation requests are processed within one business day. Alternatively, if your subscription is managed through a payment gateway (e.g. Paystack), you may cancel directly through their portal.

Reactivation

If you wish to resume your subscription after cancellation, contact admin@kelcor.co.za. Your existing licence key and data will be reactivated upon payment of the next billing cycle. No setup fee applies for reactivation within 90 days of cancellation.

Perpetual Licences

Once-off (perpetual) licences do not require cancellation. They remain valid indefinitely for the purchased version.

Privacy Policy

Information We Collect

When you purchase or register a KelCor product, we collect:

• Your name, email address, and company name (provided during purchase or registration).
• A machine fingerprint (a one-way hash of hardware identifiers) used solely for licence binding. We cannot reverse this hash to identify your hardware.
• Payment information is processed by our payment gateway partners (Paystack, Ozow) and is not stored on KelCor servers.

How We Use Your Information

• To issue, validate, and manage your software licence.
• To provide customer support and respond to enquiries.
• To send important product notifications (e.g. security updates, expiry reminders).
• We do not sell, rent, or share your personal information with third parties for marketing purposes.

Data Stored in Our Software

All project data you create within PTW System, QuoteFlow, or Safety File Manager is stored locally on your machine(s). KelCor does not have access to your project data, documents, financial records, or safety files. We do not operate cloud storage for customer data.

Telemetry

Our software transmits limited telemetry data to kelcor.co.za for the following purposes only:

• Licence validation (verifying your key is active and not revoked).
• Subscription heartbeat checks (confirming subscription status).
• Update checks (comparing your installed version against the latest release).

No project data, personal files, or usage analytics are transmitted.

Data Retention

Customer records (name, email, licence data) are retained for the duration of the licence plus 5 years for accounting and compliance purposes. You may request deletion of your personal data by emailing admin@kelcor.co.za, subject to our legal retention obligations.

POPIA Compliance

KelCor Technologies processes personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA). Our Information Officer can be contacted at admin@kelcor.co.za.

Acceptable Use Policy

Permitted Use

KelCor software is licensed for use by the purchasing entity for their own business operations. Each licence is bound to specific machines and may not be shared across organisations.

Prohibited Activities

• Sharing, distributing, or publishing licence keys.
• Circumventing or attempting to circumvent licence validation, machine binding, or subscription enforcement mechanisms.
• Using the software to produce fraudulent compliance documentation or falsified records.
• Reverse engineering, decompiling, or disassembling any KelCor product.
• Reselling or sublicensing KelCor products without written authorisation.

Enforcement

Violation of this Acceptable Use Policy may result in immediate licence revocation without refund. KelCor reserves the right to pursue legal remedies for damages arising from misuse.
